Enforcement policy - non compliance

The legislation we enforce is backed up by criminal penalties. This means if you don't comply you could be prosecuted and fined or in the most serious cases, imprisoned. However, we'll deal with breaches of the law proportionately, as set out in our Regulatory Services enforcement policy. In appropriate cases, we will try and achieve compliance with advice and education first.

Financial penalties policy for letting agents and landlords

The council can issue financial penalties for breaches of the legislation below:

  • The Redress Schemes for Letting Agency Work and Property Management Work (requirements to belong to a scheme etc.) (England) Order 2014
  • Consumer Rights Act 2015 (chapter 3)
  • Tenant Fees Act 2019
  • Client Money Protection Schemes for Property Agents (requirement to belong to a scheme etc.) Regulations 2019
  • Leasehold Reform (Ground Rent) Act 2022

Our policy on determining penalties for ground rent breaches will be published in March 2023.
