Waste disposal and the law

Check the laws for waste disposal for households, businesses and other organisations.

By law, if you produce waste then you're responsible for managing and disposing (getting rid of) that waste properly.

This includes householders and businesses, but also other organisations such as charities, churches, clubs, and public and voluntary services.

Code of Practice (law)

The law requires anyone dealing with waste to:

  • keep it safe
  • prevent it from causing litter or pollution
  • make sure it's dealt with responsibly
  • only pass it on to businesses authorised to take it

These legal duties apply to household, industrial and commercial waste. They are set out in the government’s Code of Practice

Householders and businesses

It's your legal duty to make sure your waste is taken and disposed of safely by an authorised person or business.

In most cases we'll collect household waste, either by a regular collection service or by request (such as a bulky waste collection).

Or you can take household and business waste to the tip.

If you’re giving your waste to someone else like a contractor or skip company you must make sure they're legally allowed to dispose of it.

Check on GOV.UK what you must do if you use a private waste company (opens in a new tab).

Waste management companies

It is an offence to carry waste without the correct registration.

You must register on GOV.UK as a waste carrier, broker or dealer (opens in new tab), unless you can show you're exempt.
