Elmington Regeneration Compulsory Purchase Orders (CPO)

Background and confirmation of Development Partner

The council selected Bellway Homes and Family Mosaic Housing Association as its development partners following Cabinet's decision on 17 July 2012 to approve the sales of sites C,D,E and G.

The council exchanged conditional contracts with Bellway Homes and Family Mosaic Housing Association on 26 March 2014 to enable planning permission (granted on 31 March 2015) for the redevelopment on sites C,D,E and G.

A 250 year lease was granted to councils development partners, Bellway Homes and Family Mosaic Housing Association in February 2016 on sites C & D to enable build out of 54 units. In May 2016, a 250 year lease was granted to the development partners Bellway Homes and Family Mosaic Housing Association on site E to enable build out of 89 units.

The blocks affected by the proposed re-development are:

  • 1 - 27 Benhill Road
  • 29 - 59 Benhill Road
  • 1 - 20 Houseman Way
  • 21 - 29 Houseman Way
  • 30 - 51 Houseman Way
  • 90 - 106 Benhill Road
  • 30 - 72 Lomond Grove
  • 1 - 20 Broome Way
  • 1 - 12 Flecker House

Demolition on sites C,D and E is complete and demolition of site G is expected to commence in Autumn 2016. The council is working to acquire remaining lease hold interest by agreement on all sites. Those remaining leaseholders that qualify for rehousing assistance will be offered reversion to council tenancy, shared ownership or shared equity. 

Sites D, E and G current status

The council have pursued a mixed programme of refurbishment and redevelopment of the estate since 1999 as part of its wider commitment to the regeneration of Camberwell. A substantial part of the estate has now been regenerated either by refurbishment or by redevelopment; but redevelopment of sites C, D, E and G completes phase 3 of the regeneration.

Compulsory Purchase Order (CPO)

In order for the council to complete the final part of its regeneration programme for phase 3 of the estate, the use of Compulsory Purchase Powers (CPo) were necessary to facilitate the comprehensive redevelopment on sites DE and G (where it has been unable to acquire the remaining interests by agreement).

The current status on the CPO for each site are listed below:

Site E

On the 17 February 2015, the council made the London Borough of Southwark (Elmington Estate Site E) Compulsory Purchase Order 2015 (“the Order”).

The order, together with the Council’s Statement of Reasons, was submitted to the Secretary of State for Department of Communities and Local Government (“the Secretary of State”) for confirmation on 10 March 2015.

A public enquiry was held at Tooley Street on 22 September 2015 to discuss objections for the redevelopment of Site E. The DCLG having received two objections from residents being displaced as a result of the CPO.

  • 22 December 2015 - the secretary of State for Department Communities and Local Government confirmed the order
  • 7 January 2016 - the council served notice on all remaining residents of the confirmation of the order
  • 16 March 2016 - the council made a General Vesting Declaration (GVD) and served notice specifying effect of GVD on residents
  • the effect of the GVD is that all third party interests, including mortgagees and utility companies, vested in the council on 22 April 2016

Possession Site E was acquired lawfully on 26 April 2016 and handed over to the councils development partners, Family Mosaic housing Association and Bellway Homes, to enable delivery of 89 dwellings.

Site D

  • 20 April 2015 - the council made the London Borough of Southwark (Elmington Estate Site D) Compulsory Purchase Order 2015 (“the Order”)
  • the Order, together with the Council’s Statement of Reasons, was submitted to the Secretary of State for Communities and Local Government (“the Secretary of State”) for confirmation on 19 May 2015
  • the order was confirmed by the council on 12 July 2015 under powers afforded by the Secretary of State for Communities and Local Government in a letter dated 13 July 2015
  • on 23 July 2015, the council served notice on all remaining residents of the confirmation of the order.
  • on 11 December 2015, the council made a General Vesting Declaration (GVD) and served notice specifying the effect of GVD on all residents, including mortgagees and utility companies

The effect of the GVD is that all third part interests vested in the council on 28 January 2016.

Possession of Site D was acquired lawfully on 10 February 2016 and handed over the council's development partners, Family Mosaic Housing Association and Bellway Homes to enable delivery of 54 dwellings.

Site C

The council didn't use its statutory powers to acquire third party interests; the council owned the freehold of site C and occupied the former Harris Street neighbourhood housing office.

Site G

  • on 26 March 2015, the council made the London Borough of Southwark (Elmington Estate Site G) Compulsory Purchase Order 2015 (“the Order”)
  • the Order, together with the Council’s Statement of Reasons, was submitted to the Secretary of State for Department of Communities and Local Government (“the Secretary of State”) for confirmation on 20 April 2016
  • on 29 July 2015, the council confirmed the Order having been given authority by the Secretary of State for Department for Communities and Local Government to do so
  • on 6 August 2015, the council served notice on all remaining residents of the confirmation of the order
  • on 6 May 2016, the council served notice of its intention to make and implement a General Vesting Declaration (GVD) on all residents, with an expiry date of 6 July 2016
  • on 26 July 2016, the council made a GVD and served notice to all residents specifying the effects of the GVD, including mortgagees and utility companies

The effect of the GVD is that all third party interests will vest in the council on 6 September 2016.

Possession of site G is expected on 6 September 2016 (the vesting date) and handed over the council's development partners, Family Mosaic Housing Association and Bellway Homes, to enable delivery of 82 dwellings.
