What is the New Southwark Plan?

The New Southwark Plan (NSP) will be a new borough-wide planning and regeneration strategy up to 2033. Not only will it set out planning policies to guide development, but it will also explain how development will be delivered and may inform future decisions about investment in infrastructure.

The Plan is made up of three sections:

  1. area visions - setting out the aspirations of the borough’s distinctive neighbourhoods
  2. planning policies - informing decisions on planning applications and development proposals
  3. site allocations - potential development sites with specifications for development requirements

NSP submission in January 2020

The council submitted the NSP to the Secretary of State on 16 January 2020. This started the 'Examination in Public' process, which is the last stage of the plan-making process.

On 17 January, we were allocated two Inspectors by the Planning Inspectorate. The Inspectors were David Spencer BA(Hons) DipTP MRTPI and Philip Mileham BA(Hons) MA MRTPI.

Throughout the examination process, the Planning Inspectors  examined and assessed the NSP based on the following criteria:

  • does it meet the duty to cooperate?
  • does it meet all the necessary legal requirements?
  • is it sound?
  • is it based on evidence?
  • can it be delivered?
  • does it comply with national and regional policy?

Inspectors’ initial matters and concerns in April 2020

The Inspectors provided their summary of initial matters and concerns in their letter dated 20 April 2020 (EIP14). Our full response and agreed way forward was set out in Southwark’s response to Inspectors letter dated 20 May 2020 (EIP16) and the Inspectors’ further response letter dated 2 June 2020 (EIP25). Consultation on the Proposed Changes to the Submitted New Southwark Plan

In the Inspectors’ letter they asked us to make amendments to the New Southwark Plan and to provide more supporting information and evidence. We did this in the 'Proposed Changes to the Submitted New Southwark Plan'. We consulted on this document from 27 August to 2 November 2020.

Meeting with Inspectors

On 6 November 2020, planning officers and the EiP Programme Officer from Southwark Council (LBS) met with the Planning Inspectorate (PINS) to discuss how to do a virtual Examination in Public. The minutes of this meeting have been added to the webpage.

Matters, Issues and Questions (MIQs), guidance note and draft hearing programme

The Inspectors issued their Matters, Issues and Questions (MIQs), an accompanying guidance note and a draft hearing programme for the examination.

By Monday 11 January 2021, the Programme Officer received emails or letters from those who wish to be heard at the Examination Hearings, indicating which sessions, relevant to their representations, they wanted to attend. This included confirmation from those who indicated in their initial representations that they wished to participate.  

In line with guidance from PINS, the deadline for any written statements was 2 February 2021. We accepted some written statements up to Tuesday 16 February 2021.

  • a letter regarding Publication London Plan dated 6 January (EIP124)
  • the privacy notice for virtual hearings in respect of data protection dated 7 January (EIP125)

Updated hearings schedule

The hearings took place in two parts. The first part opened on 23 February 2021 at 10am and hearings were held into the proposed strategy and policies of the New Southwark Plan.

The second part took place on 20 April and considered the proposed sites in the Plan, together with policies for the delivery of the plan.

The Examination in public

The public hearing sessions were chaired by the Inspectors. These were an essential part of the examination process. Participants included council officers, and people or organisations that submitted a representation during Regulation 19 consultation and whom were invited by the Inspectors.

Main Modifications

The Examination in Public (EiP) hearing sessions for the New Southwark Plan (NSP) ended on Friday 30 April 2021. The sessions are available to watch on Chapter 8 - Hearing sessions. Following the Examination in Public, the council asked the Inspectors under section 20(7C) of the 2004 Planning and Compulsory Purchase Act as amended) to recommend ‘main modifications’  (changes that materially affect the policies) to make a submitted local plan sound and legally compliant (EIP233). The Main Modifications were consulted on for 7 weeks between 6 August and 24 September 2021.

Chapter 9 - Main modifications provides more information on the next steps of this round of consultation.

Adopting the Plan 

We have now received the Inspector’s Report and recommended Main Modifications. These are provided at Chapter 10 – Adopting the Plan. This concludes the Examination in Public of the Plan. The next steps for adopting the Plan are provided at Chapter 10.

The purpose of the examination webpage

To facilitate the smooth running and transparency of the examination, this page provides access to all the relevant documents, including Submission Version NSP and the supporting documents along with the previous versions of the plan and documents. 

The programme officer

The council has appointed a programme officer for the examination process, who undertakes the administration of all aspects of the examination under the Inspector’s direction, including arrangement of hearing sessions and all communications outside the hearing sessions between the Inspector, Southwark Council and other parties.
