Street furniture licence terms and conditions

View our street furniture licence terms and conditions before you apply.

Any failure to comply with the terms and conditions listed below will render your license invalid. 

Make sure you read and fully understand our conditions before signing the agreement.

  1. You must clearly display your licence at all times. Our inspectors must be able to see it without needing to ask.
  2. You may use only the area stated in your licence. You must not place any items outside this space.
  3. When not in use, all street furniture or goods must be stored off the public highway in a suitable and secure place.
  4. You must have public liability insurance worth at least £5 million before placing anything on the public highway.
  5. You must not fix or attach any item to the surface of the public highway. If any damage is caused, you are responsible for repair costs.
  6. You are responsible for any injury, damage, or loss that arises from your use of the public highway. You must protect Southwark Council against any claims and cover any costs if we are held responsible.
  7. Street furniture must always be safe, stable, fit for purpose, and properly maintained.
  8. Unless your licence states otherwise, leave at least 1.5 metres of unobstructed space on the pavement or by the kerb. This must not be blocked by furniture or customers.
  9. Licence holders must avoid causing nuisance, disturbance or danger to neighbouring properties or users of the highway.
  10. You must regularly clean and tidy the licensed area and remove litter and waste from around the premises.
    If requested by us, you will provide mobile litter bins and pay any associated commercial waste fees.
  11. Remove all street furniture or goods from the highway immediately if required by the council, the police, emergency services, or statutory undertakers. You may only return items with our prior approval.
  12. If you breach these terms, we may ask you to fix the issue, revoke your licence, and charge you for any reasonable costs.
  13. Any notice from us will be addressed to you and sent by email, post, or left at the premises. That is sufficient service.
  14. If your licence ends early or is revoked, fees for any remaining period will not be refunded.
  15. Your licence covers a defined area (in square metres). Items outside this area may be removed under the Highways Act 1980.
  16. By 10pm each night, remove all street furniture or goods from the highway, or store them securely or render them unusable.
  17. We reserve the right to add or change local conditions at any time.
