Applying for a possession order

We can only apply for a court date 28 days after we have served a notice of termination.

At the court hearing, we only have to satisfy the judge that the notice has been correctly served and that an opportunity has been given for a review. We do not have to prove the case by providing evidence (this is the purpose of the review hearing).

Once a possession order has been granted, we will apply to evict you. When you have been evicted, it is likely that we will decide that you have chosen to be homeless and we will not rehouse you.

Your rights

There are some rights that you do not have as an introductory tenant and will only get once you become a secure tenant. These are

  • The right to buy - as an introductory tenant you do not have the right to buy
  • The right to exchange
  • The right to take in lodgers and
  • The right to compensation if you improve your home and vacate the property (while an introductory tenant)
