Appealing Against a Vehicle Clamp or Removal from a Housing Estate

Appeals

This page gives information about how to make an appeal against the clamping or removal of a vehicle when it was parked on an estate.

Please remember that making an appeal does not guarantee you a refund. The majority of appeals are rejected. This is because there were no legal grounds to make an appeal.

The step-by-step guide to making an appeal

Please read the information given below, starting with step one. This should tell you everything you need to know about how to make an appeal.

Step one - Are you in a position to make an appeal?

For your appeal to be considered by the council

  • You must have a permit and tax for the vehicle
  • You must have paid the enforcement fees before appealing
  • We must have received your appeal claim within 28 days of you paying the enforcement fees

If you have a permit and tax for the vehicle, you have paid your enforcement fee and we will receive your appeal claim within 28 days of you paying the enforcement fee, please go to step two.

Step two - Do you have grounds to make an appeal?

If you have read step one and you believe you are in a position to make an appeal, you now need to make sure you have grounds to make an appeal.

Please read our guidelines. These guidelines will help you decide if you have grounds to make an appeal. The following link opens in a new windowView our appeal guidelines (pdf 28kb). To view this document, you need Adobe Acrobat Reader .

If you would like to receive the guidelines through the post, please call us on 0844 800 2736,
or email parking@southwark.gov.uk.

If you have read the guidelines and you have grounds to make an appeal, please go to step three.

Step three - Making an appeal

If you have read our guidelines and think that you have grounds to appeal, please fill out our clamp and removal appeal form and send it back to us along with any other relevant receipts or documents. Please make sure you take a copy of everything you send to us.

Please make your appeal as clear as possible, and only give information that is relevant to the appeal. Courtesy and accuracy in your appeal will be noted and appreciated. View the clamp and removal appeal form (pdf 18kb). To view this document, you need Adobe Acrobat Reader.
