Rehousing and Leaseholder Policies

Rehousing and leaseholder policies for the Aylesbury were agreed by the council’s executive committee on September 26 2006.

Rehousing policy

The policy explains that every tenant on the estate who wants to be, will be rehoused in a new housing association property. Other tenants may opt to be rehoused in an existing council property elsewhere in Southwark.

The policies have been formed after many months of hard work by the members of the rehousing and leaseholder sub group. This group comprises of residents, council and Aylesbury New Deal for Communities (NDC) officers. The sub group has worked through an extensive range of issues to formulate comprehensive policies.

We will be holding a series of events for Aylesbury residents to explain rehousing options to tenants and leaseholders over the coming months. We will be forming a rehousing team, which is a dedicated team of specialists that will visit every resident, starting in the south west corner, to assess their housing needs. The team will be available on an ongoing basis to answer all your questions.

The main aspects of the rehousing policy

2,200 new homes will be built and managed by housing associations. Assessment of your housing needs will inform the size and type of new properties to be built and will ensure there are sufficient properties to rehouse all tenants who select this option.

All tenants will be asked to decide which rehousing route they would like to follow. Tenants can either move to a new housing association property or to an existing council housing within the borough. To ensure the council can make decisions for everybody, this decision will be binding. 

Tenants who wish to remain as council tenants will be offered alternative accommodation within an existing council property.

Secure tenants being rehoused by the council as part of the redevelopment will be entitled to compensation for the loss of their home. This is known as ‘home loss’ and is currently fixed at £4,000. We will cover the cost of your removals, disconnections and reconnections. 

Tenants who are located in the south west corner will be rehoused during the first phase. They will be offered the option to return to the development as properties become available.

All tenants will receive rehousing to meet their needs as assessed under council policy, although there will be opportunities for some households moving from larger properties to be allocated a property with an extra bedroom.

Home owner policy

The main aspects of the home owners policy for Aylesbury residents

  • Home owners will be entitled to the open market value of the property and either a Home Loss payment of 10% or a Basic Loss payment of 7.5%.
  • Home Loss is paid where the owner has lived at the property for at least one year prior to the date of acquisition. Basic Loss is paid where it has been owned for more than one year, but the owner does not live at the property.
  • Home owners will also be reimbursed by the council for costs associated with the move. These are known as disturbance costs.

NB: These payments do not apply to option (e) outlined below.

Options for home owners

  • (a) Buying a property on the open market – the ‘do it yourself’ option.
  • (b) Buying a shared ownership unit – the part buy / part rent option: where the compensation and other savings is used to purchase the equity of the home and the owner pays rent on the rest.
  • (c) Buying a retained equity unit – the part buy option: when the compensation and other savings is used to purchase a percentage of the equity of the home. This percentage will be determined by the council and housing associations at a later date. A charge is placed on the property.
  • (d) Comparative value transaction – the ‘property swap’ option: moving to a council property of similar value.
  • (e) Sitting tenant option – the ‘below market value’ option: The property will be purchased at a reduced value and the owner will become a tenant of the council with rights to rehousing.
  • (f) Becoming an RSL or council tenant – the ‘safety net’ option.

Some of the options are created by the redevelopment process itself and the council will be setting requirements in the upcoming competitions to select partners
