Scrutiny Review of Executive Decisions

The overview and scrutiny committee (OSC) can review decisions made by the executive or on behalf of the executive by an individual executive member, community council or chief officer. This is known as 'calling in' the decision.

There are rules around calling-in decisions. The key ones are

  • Decisions may only be called-in in certain instances such as where it is believed there was inadequate consultation or the decision breaches human rights
  • The chair or vice chair and three other members of OSC all agree the decision should be called-in
  • The call-in must be requested within five working days of the decision being published

The decision will then be reviewed by OSC, normally within two weeks from the date of the call-in request.

OSC can recommend the decision is reconsidered by the original decision-taker.

Decisions called-in during 2007-08

April 21 2008

Disposal of various Council owned properties (pdf 79kb)
Decisions taken by Executive April 8 2008.

The decisions can be implemented.  The executive’s decisions to dispose of 39B Consort Road and 91-99 Athenlay Road were upheld as they were taken in line with the relevant policies and procedures and in line with the needs of the council’s capital programme.  The committee encouraged officers and the Spike Surplus Scheme to enter into dialogue regarding the sale of 39B Consort Road and requested that officers show flexibility in regard to the timescale if it appeared that viable progress was being made, up to the lease expiry date.  The committee would welcome clarity from the executive on the balance to be taken in future between maximising property disposal income against maximising the amount of registered social landlord and council affordable housing build.

Gateway 2 - Contract Award Aproval - Modernisation Programme Consultancy (pdf 64kb)
Decisions taken by Executive Member for Resources April 9 2008.

The decisions can be implemented.  The committee asked for a further report in September/October 2008 on the design and implementation of the modernisation programme office; the initial, diagnostic phase of the consultancy testing the council's preparedness for business transformation, including efficiencies planning; and any business cases approved for phase 2 of the contract and the associated draft benefits realisation plan.

March 31 2008

Potters Fields site - decision on future options (closed report)
Decision taken by Executive March 19 2008.

The decisions can be implemented.  The chief executive was asked to report back to a future meeting of the comittee in respect of financial risk management and the governance structure of the project until the end of the year.

November 7 2006

Appointment of a local education authority (LEA) primary school governor to Cathedral School (pdf 33kb)
Decision taken by Borough and Bankside community council, October 17 2006.

The decision can be implemented. However in light of concerns about the LEA school governor appointment process, the broader issue of the appointments process was referred to the children's services and education scrutiny sub-committee for further review.

Decision taken by strategic director of regeneration, December 19 2006.

The decision can be implemented. The strategic director of regeneration was asked to report back to the committee in April 2007 on a number of areas that the committee was concerned about.

The decision can be implemented.

Integrated waste management solution contract - invitation to negotiate evaluation and preferred bidder shortlist (pdf 40kb)
Decision taken by executive, February 13 2007.

The decision can be implemented. The committee asked the head of housing and sustainability to provide future briefings in order to update the committee on progress in respect of the contract.

Leisure centre investment strategy (pdf 32kb)
Decision taken by executive, February 13 2007.

The decision can be implemented. The committee endorsed the Capital Programme and Leisure Centre Investment Strategy and called on the executive member for culture, leisure and sport to work with stakeholders to seek partners and additional funding in order to achieve the regeneration of Camberwell Leisure Centre centred around swimming provision.

April 30 2007

Relocation of reference library (pdf 36kb)
Decision taken by executive member for culture, leisure & sport, April 4 2007.

The decision can be implemented.

The committee agreed

To welcome the decision to take short-term action to make the Newington Reference Library compliant with the Disability Discrimination Act 1995, welcome the expansion of the number of workstations and desk spaces and the extension of the opening hours.

To note the work to investigate options for the future of the library and hope that this building will form the basis of the new state-of-the-art library for the regenerated Elephant.

To call on the strategic director of environment & housing to report back to its September meeting on the consultation process for the future of the whole site and the proposals for community engagement.

May 10 2007

Office accommodation programme - updated strategy, property acquisition and business case (pdf 37kb)

The committee accepted the decision, subject to a community impact assessment and statement being produced and agreed by the executive prior to the signing of any Agreement to Lease.
