Licensing Update

Gambling Act 2005 

Three year review of the council’s statement of gambling licensing policy

Your comments are invited on the draft revised Southwark statement of gambling licensing policy for 2010 to 2013, which sets out the principles the council will apply when carrying out its function under the Gambling Act 2005.

The statement of policy, which was first approved in 2007, is required under the Act to be reviewed every three years. This first revision of the policy takes into account the latest guidance for local authorities from the Gambling Commission, particularly regarding definition of premises, but otherwise has not been altered in any substantial way.

A hard copy may be obtained directly from the health safety and licensing team (please see our contact details page).

Please provide any comments you may have on any aspect of the policy in writing to the licensing team by Friday 20 November 2009.

All feedback will be taken into consideration before the final revision of the policy is formally approved by council assembly.

Licensing Act 2003

Minor variations process

On July 29 2009 two new licensing processes came into effect under the 2003 Act. These provide

  • a simplified process for minor variations to premises licences and club premises certificates that do not impact adversely on the licensing objectives
  • for the removal of the requirement for a designated premises supervisor and personal licence holder at community premises.

The minor variations process is intended to cover

  • minor changes to structure or layout
  • small adjustments to licensing hours
  • removal of out of date, irrelevant or unenforceable conditions
  • the addition of volunteered conditions.

Consultations on saturation policies

Thank you to everyone who responded to our recent consultation exercises on the potential introduction of a new saturation policy dealing with the cumulative impact of alcohol licensed premises in the Borough and Bankside area and on the potential extension of the current Peckham saturation area.

The responses are currently receiving consideration. These will shortly be reported to the council’s licensing committee for debate and recommendation on to council assembly.
